Welcome to TCG BID (the "Site"), an online auction platform operated by Cyber Fire Limited ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, you are prohibited from using the Site.

1. Eligibility

To use the Site, you must be at least 18 years old or have reached the age of legal majority in your jurisdiction.

By using the Site, you confirm that you have the legal capacity to enter into a binding agreement.

We reserve the right to refuse service or terminate accounts at our discretion, including for violations of these Terms.

2. Account Registration

To participate in auctions, you must register an account and provide accurate, complete, and up-to-date information.

You are responsible for safeguarding your account credentials and for all activities conducted under your account.

You must promptly notify us of any unauthorized access to or use of your account.

3. Auction Rules

Bidding: All bids are final and cannot be withdrawn unless expressly permitted by the Site. You are responsible for ensuring the accuracy of your bids.

Auction Formats: The Site may offer various auction types, such as standard, reserve, or buy-now options. Details for each format will be specified in the listing.

Winning Bids: The highest bidder at an auction’s close, provided any reserve price is met, is obligated to complete the purchase.

No Shill Bidding: Sellers, their agents, or affiliates are strictly prohibited from bidding on their own listings to artificially increase prices.

Auction Cancellation: We may cancel or modify an auction at any time due to technical difficulties, suspected fraud, or other exceptional circumstances.

4. Listing Items

Sellers must provide accurate, comprehensive, and truthful descriptions of items, including their condition, authenticity, and any defects.

Prohibited items, such as illegal goods, hazardous materials, or counterfeit products, are not permitted. Refer to our Prohibited Items Policy for a complete list.

Sellers are responsible for ensuring their listings comply with all applicable laws and regulations.

5. Fees and Payments

Fees: Sellers may incur listing fees, final value fees, or other charges as detailed in our Fee Schedule. Fees are non-refundable unless otherwise specified.

Payments: Buyers must complete payment for won items within 5 days of the auction’s close using approved payment methods.

Taxes: Buyers and sellers are responsible for any taxes applicable to transactions conducted on the Site.

Non-Payment: Failure to pay for a won item may result in account suspension, transaction cancellation, or legal action.

6. Shipping and Delivery

Sellers are responsible for shipping items to buyers as outlined in the listing terms.

Buyers must provide accurate shipping details and cover any applicable shipping costs.

We are not liable for delays, damages, or losses occurring during shipping.

7. Dispute Resolution

Buyer/Seller Disputes: Disputes between buyers and sellers should be resolved directly. We may offer mediation services at our discretion but are not obligated to intervene.

Refunds and Returns: Refunds or returns are governed by the seller’s return policy as stated in the listing. If no policy is provided, refunds or returns are not required.

Site Disputes: Any disputes with us shall be resolved through binding arbitration in Hong Kong, conducted under the rules of the Hong Kong International Arbitration Centre. You waive any right to pursue class-action lawsuits.

8. Intellectual Property

All content on the Site, including text, graphics, logos, and software, is owned by Cyber Fire Limited or its licensors and is protected by copyright and other intellectual property laws.

You may not reproduce, distribute, or create derivative works from Site content without our prior written permission.

9. Limitation of Liability

The Site is provided "as is," without any warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.

We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Site, including losses related to bidding, purchasing, or transaction failures.

Our total liability for any claim arising from these Terms or your use of the Site is limited to the fees you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Cyber Fire Limited, its affiliates, and their respective officers, directors, and employees from any claims, losses, or damages, including legal fees, arising from your use of the Site or breach of these Terms.

11. Termination

We may suspend or terminate your account or access to the Site at our sole discretion, with or without notice, for reasons including but not limited to violations of these Terms or suspected fraudulent activity.

Upon termination, your right to use the Site will cease, but provisions of these Terms concerning liability, indemnification, and dispute resolution will remain in effect.

12. Governing Law

These Terms are governed by the laws of Hong Kong, excluding its conflict of law principles.

Any legal action arising from these Terms, except as provided in the arbitration clause, must be brought in the courts of Hong Kong.

13. Changes to These Terms

We may revise these Terms at any time by posting the updated version on the Site. Changes take effect immediately upon posting.

Your continued use of the Site following any changes constitutes your acceptance of the revised Terms.
